HIV: To disclose or not to disclose

Are secrets, for HIV+, a good thing?

As a preliminary matter, the law obliges HIV positive persons to disclose his/her HIV status and health condition to his/her spouse or sexual partner at the earliest opportune time (Section 45, RA 8504). Failure to do so would, at the minimum, subject the HIV positive person to civil liability. I am of the opinion that, in some instances, non-disclosure, especially if coupled with bad faith, will also subject the person to criminal liability.
